O-1 Overview
The O-1 visa is designed for individuals with extraordinary ability in science, arts, education, business, or athletics, or for those with a distinguished record of exceptional achievement in the motion picture or television industry who have earned national or international recognition.
The O nonimmigrant classification are commonly referred to as:

O-1 Visa: Employer, Agent, or Self-Employed Options
The O-1 visa can be filed by a U.S. employer, an agent, or a self-employed individual, depending on your situation.

1. Employer-Sponsored O-1
This is the most common route. A U.S. company willing to provide an employment contract or job description can serve as your O-1 petitioner.

2. Agent-Sponsored O-1
Ideal for freelancers, creatives, or professionals working on multiple projects. Actors, models, content creators, and athletes without a single employer can use a U.S. agent to file Form I-129 on their behalf.

3. Self-Employed O-1
Since early 2025, USCIS allows self-employed individuals to petition for themselves. To qualify:
· You must own or control a real business
· The business must have active operations, revenue, and clear business plans
· Simple setups with you as the sole owner and employee, without independent oversight, do not qualify
No minimum salary requirement
Unlike the H-1B, the O-1 visa has no prevailing wage rules, giving employers more flexibility to hire you even if they can’t meet H-1B salary levels.
Extension Flexibility
O-1 visas can be granted for up to 3 years initially, and then extended in 1 year increments indefinitely as long as the individual continues to meet requirements.
Pathway to a Green Card

No Annual Cap
